The rules for providing services in electronic form regulate the scope and conditions of provision by SUPPORT AR Sp. z o.o., based in Gdańsk (postal code: 80-809), at 1/9 Milskiego Str., registered in the National Court Register, maintained by the District Court Gdańsk – Północ in Gdańsk, 8th Commercial Division of the National Court Register under the number KRS 0001038041, NIP: 5833478550, share capital: 5,000 PLN, fully paid, phone: +48798633877, email: migrant.vision@gmail.com, correspondence address: 17a/2 Okopowa Str., 80-819, Gdańsk, hereinafter referred to as the “Service Provider”, services provided in telephone mode and electronic form, as well as the transmission of commercial information.
The regulations were prepared in accordance with the provisions of:
* Law of July 18, 2002, on the provision of services in electronic form (i.e., as of 2020, paragraph 344 with subsequent amendments);
* General Data Protection Regulation (GDPR); Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data, as well as repealing Directive 95/46/EC. The EU. № 119, p. 1);
* Law of July 16, 2004, the Telecommunications Law (i.e., as of 2023, paragraph 1394 with subsequent amendments).
GENERAL PROVISIONS
- Definitions used in the Regulations:
* Law – the law “On the provision of services in electronic form” of July 18, 2002 (i.e., as of 2020, paragraph 344 with subsequent amendments).
* GDPR – General Data Protection Regulation – Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC. EU L 2016 № 119)
* ICT system – a set of interacting information devices and software that process and store data, as well as transmit and receive data through telecommunications networks using the appropriate type of terminal equipment under telecommunications legislation.
* Services provided in electronic form – Services performed at a distance (without the simultaneous presence of the parties) by sending and receiving data through information systems, at the individual request of the recipient of the services, with the data being transmitted through a telecommunications network within the meaning of the law of July 16, 2004 – Telecommunications Law.
* Electronic communication means – technical solutions, including ICT devices and interacting software, allowing individual communication at a distance using data transmission between ICT systems, including email;
* Email address – a designation of an ICT system that allows communication through electronic communication means, including email;
* Commercial information – any information directly or indirectly intended to promote the goods, services, or image of an entrepreneur;
* Service Provider – SUPPORT AR Sp. z o.o., based in Gdańsk (postal code: 80-809), at 1/9 Milskiego Str.;
- The Service Provider delivers services in telephone mode and in electronic form from the address: migrant.vision@gmail.com, website www.migrantvision.com.
- Recipients of the services must be individuals who have reached the age of 18 and have full legal capacity.
- By ordering a service, the Recipient of the service confirms that he/she has read its description, the terms of its provision, and declares the acceptance of all the provisions of these Regulations.
- After the subscription fee has been paid, the service provider delivers the services as stipulated by these Regulations.
- Subscription activation is equivalent to activating access to the services provided for in these Regulations and is equivalent to full acceptance of all its terms without the need to sign an additional agreement.
TYPE AND SCOPE OF SERVICES PROVIDED
- The Service Provider offers consultation services in various areas of life. The information is of a general nature and may not apply to a specific caseand it is not a consultation in the field of tax legislation. The Service Provider is not responsible for any harm if the information does not produce the expected result for the Recipient of the service or cannot be applied to a specific situation.
- Services provided under these Regulations are available from Monday to Friday from 9:00 AM to 6:00 PM.
- The service is chargeable. The price is indicated on the company’s website and may change. In case of a change in the service price, the new price will be displayed on the website www.migrantvision.com or notified by email. If the Recipient of the service disagrees with the changed price, he/she can send an email to migrant.vision@gmail.com to terminate the Agreement.
- The Recipient of the service is obliged and agrees not to use the content of the received information for illegal purposes, those prohibited by law, causing harm to the rights and interests of third parties, or in any way that may damage, disrupt, overload, deteriorate, or hinder the normal use of the services.
- The Service Provider is in no way responsible for the content of other websites or electronic services that do not belong to or are not under the control of the Service Provider and to which links have been placed as part of the service provision.
- The use of services may involve risks characteristic of online activities. The Recipient of the service is aware of the threats that arise on the Internet, including the possibility of third parties intercepting passwords or infecting the Recipient’s devices with viruses, as well as the losses that may result from such events. The Recipient of the service is obliged to keep passwords and login data for his/her account confidential.
- The service is provided in telephone mode and, if necessary, delivered in electronic form, including text email messages or other graphic files compatible with any device that can display such content.
- According to the Agreement, the Service Provider delivers the Recipient the service with access to the website, information posted on it, as well as consultation services in telephone mode. The use of the website and obtaining information is allowed for the Recipient’s own and non-commercial purposes.
- The time for provision of service by the Service Provider according to these Regulations is 15 minutes per Recipient of the service per day. If additional questions arise for the Recipient of the service, this time can be extended to 30 minutes if the questions relate to the same topic.
- If the service is not delivered in a timely manner, the Recipient of the service has the right to demand its provision from the Service Provider. If the Service Provider does not deliver the service immediately or within an additional period (5 hours) directly agreed upon by the parties, the Recipient of the service can terminate the Agreement by notifying the Service Provider via email.
- The subscription is indefinite and expires upon the termination of the Agreement, no earlier than 14 days after the official notice of the termination by the Recipient of the service to the Service Provider via email, or the termination of the Agreement by the Service Provider due to the Recipient’s breach of the terms of these Regulations.
- The Recipient of the service is obliged to use the received information in accordance with applicable law and fair practice, as well as respect the personal rights, copyright, and intellectual property rights of the Service Provider and third parties.
TERMS OF PROVIDING SERVICES
- The Service Provider offers services to the Recipient of the service in the scope and on the terms specified in these Regulations.
- The Recipient of the service agrees to adhere to the rules of these Regulations.
- The Service Provider undertakes to commence the provision of the service within the period provided by these Regulations.
- The Service Provider is obliged to obtain consent for sending marketing and commercial information in electronic form to the email address of the Recipient of the service.
- The Recipient of the service is obliged to refrain from abusing electronic communication means and not to provide the Service Provider with content through ICT systems that:
* violate the rights of third parties, generally accepted social norms, contravene applicable laws, or violate the legitimate interests of the Service Provider and these Regulations,
* cause hindrances in the operation or overload ICT systems of the Service Provider or other individuals who directly or indirectly participate in the provision of services in electronic form,
The Recipient of the service is obliged to use the website www.migrantvision.com and the provided services in accordance with applicable law, personal rights, copyright, and intellectual property rights of the Service Provider and third parties.
- The Service Provider is not responsible for any damage caused by the use of the services in a manner contrary to applicable laws, fair practices, or in any way incompatible with these Regulations.
- Information about changes in the method and scope of services delivered by the Service Provider, as well as information requested by the Recipient of the service in accordance with Art. 6 of the Law “On the provision of services in electronic form”, will be provided through the website and/or via email.
DURATION OF THE AGREEMENT
- Services are delivered on a paid basis for an indefinite period, in telephone mode, immediately after activating access to the services provided by these Regulations.
TERMINATION OF THE AGREEMENT
- The Recipient of the service has no right to withdraw from the Agreement once the Service Provider has begun delivering the service.
- The condition for concluding the Agreement is the Recipient’s familiarity with the rules and the granting of consent to the Service Provider for:
– the start of service provision,
– waiving the right to withdraw,
– by submitting a declaration that the Recipient of the service was informed before the start of service provision that after the service is delivered by the Service Provider, he/she will lose the right to withdraw from the Agreement, and confirming this by gaining access to the website www.migrantvision.com, the information posted on it, and consultation services in telephone mode.
- The recipient of services who has concluded a remote contract may withdraw from it within 14 calendar days without explanation and without any costs, except for the costs provided for in Article 35 of the Law on Consumer Rights of May 30, 2014 (from 2014, paragraph 827 of the um.)
TECHNICAL REQUIREMENTS FOR USING SERVICES PROVIDED IN ELECTRONIC FORM
- Technical requirements necessary for using the Service Provider’s websites:
* a computer, laptop, or other multimedia device with internet access and a web browser that supports HTML5;
* access to email;
* enabling the ability to store cookies and support Javascript in the web browser.
NEWSLETTER
- The newsletter is periodic provision of information related to IT solutions and topics covered by the websites of the Service Provider, which may contain advertising and commercial information.
- The service is provided free of charge for an indefinite period (i.e., until consent is revoked).
- Commercial information is considered ordered if the Recipient of the service has consented to receive such information (newsletter), specifically by providing an email address identifying it during registration in the information system of the Service Provider.
- Providing an email address is necessary to use the “newsletter” service. At the same time, it constitutes consent to receive commercial information from the Service Provider through electronic communications in accordance with Art. 172 of the Telecommunications Act and Art. 10 of the Act on the Provision of Electronic Services.
CUSTOMER’S CONSENT TO DATA PROCESSING
- The Recipient of the service is responsible for the accuracy and timeliness of the personal data provided. In case of well-founded doubts, the Service Provider has the right to demand that the Recipient of the service correct and document the accuracy of the data.
- The processing of personal data will be carried out under the conditions specified in the privacy policy.
- Data transmission and consent to their processing by the Recipient of the service are always voluntary but necessary to use the services provided electronically.
- Acceptance of these Regulations is intended as explicit consent to the processing of personal data provided at the time of launching the electronically delivered service, or sent by email or contact forms on the Service Provider’s websites.
COMPLAINTS PROCEDURE
- Complaints about non-performance or improper performance of services by the Service Provider may be submitted within 30 days from the date when the service was or should have been delivered, in writing at the Service Provider’s registered office or electronically by sending a request to migrant.vision@gmail.com.
- The application for the complaint should contain information and circumstances related to the subject of the complaint, as well as contact details of the person submitting the complaint.
- The Service Provider reviews applications immediately, no later than 14 days from their submission.
- If the conditions for reviewing the complaint are violated, the complaint may not be considered.
CHANGES IN THE REGULATIONS
- In matters not regulated by these Regulations, the provisions of generally applicable law apply.
- The Service Provider reserves the right to make changes to the Regulations, in particular due to changes in legislation, to the extent that these changes affect the registration and implementation of the current Regulations.
- Changes to the Regulations enter into force after 5 days from the date of notifying the Recipients of services of the changes. The exact date of the changes taking effect will always be indicated in the notification to the Recipient.
- Without prejudice to other rights arising from the Regulations, in case of non-acceptance of changes to the Regulations, the Recipient of the service has the right to terminate the Agreement after an official notification by the Service Provider via email to the address migrant.vision@gmail.com.
FINAL PROVISIONS
- The Service Provider will make every effort to ensure the correct operation of the website, but is not responsible for disruptions in the operation of the user’s account in case of technical problems beyond the control of the Service Provider.
- In matters not regulated by the Regulations, the provisions of Polish law apply.
